Facts
The plaintiff was assisting her mother, the cross-defendant Debra White, in an effort to close an allegedly malfunctioning window in their apartment unit owned by Raymond Newsom, Joanne Newsom and Norma Greenfelder and managed by Mattson Real Estate Services Inc. The plaintiff and the cross-defendant claimed that the window had been malfunctioning throughout the entire duration of their tenancy - approximately 20 years. The plaintiff and the cross-defendant also claimed that they would frequently attempt to manually close the window since the crank mechanism did not properly work. On July 19, 1999, the plaintiff Lovie White was attempting to close the window from the outside when her arm went through the glass causing alleged injuries.

Injuries
The plaintiff was taken to the hospital and received sutures to her arm. An eight-inch piece of glass was protruding and thereafter removed from her forearm. Residual complaints consist of pain, numbness, tingling and a scar.
