Facts
The plaintiff driver, Carmelinda Jimenez, 38, and her passenger, Venny Velasco, 16, were injured when their vehicle was hit in a multiple chain reaction collision. The plaintiffs were stopped at a red light and the defendant Quick was traveling east and made a left turn. The defendant Willie was traveling west on the same street and broadsided the defendant Quick's vehicle. The impact pushed Quick's vehicle laterally and it struck the plaintiffs' stopped vehicle. Both defendants raised the issue as to the color of the traffic lights at the intersection at the time of the collision.
Settlement Discussions
According to the defendant, there were no demand. The defendant offered $1,000 to the plaintiff driver and $500 to the plaintiff passenger, both by way of C.C.P. Section 998.
Damages
According to the defendant, the plaintiff driver claimed damages of $15,000; the plaintiff passenger, $7,500.
Injuries
Both plaintiffs claimed soft tissue injuries in the nature of a whiplash. The plaintiff Jimenez underwent an MRI to rule out a herniated disc in the neck.
Result
Both defendants were found negligent but neither was found to have caused the plaintiffs any injuries or damages.
