Dennis Heacock, age 56, entered the garage of a condominium complex in Culver City where he rented storage and workshop space to move a van he had parked in a friend's parking space. After he moved the van, as he was walking around the back of the van, he noticed it beginning to roll. He started toward the driver's door of the van in an attempt to stop it from rolling, but in so doing slipped and fell on a sludge-like substance. A resident of the complex and former president of the homeowners association stated in declaration that he had noticed the substance on the garage floor earlier on the same day, and that it was caused by the end-cap of a drain pipe occasionally falling off, allowing waste water and crud to accumulate on the floor.

Heacock suffered an intertrochanteric hip fracture that required surgery. Richard Pollis, his medical expert, stated that Heacock would need one or more additional surgeries to remove a retractable screw used to repair the original fracture.
