The plaintiff, Grange Insurance, brought the subject subrogation suit, as the first party insurer for Jean Fecteau, who suffered a fire loss in his rental property at 5931 Rye Way, Carmichael. Grange Insurance Association paid $30,747 for the damages incurred as a result of the fire. The property was being occupied by a tenant of Fecteau; the tenant was not at home when the fire occurred.

Settlement Discussions

The plaintiff demanded, prior to trial, $30,746. The defendant offered $5,000.

Other Information

Subsequent to trial, the defendant filed a motion for expert fees (in light of the expired C.C.P. Section 998 offer) along with a memorandum of costs. The judge awarded the defendant expert fees and costs in the amount of $35,315. No appeal was filed by the plaintiff.
