Facts

On Jan. 15, 2002, the plaintiff, age 48, tripped over an elevated section of a pathway leading to the entrance of a rental unit. The force of the trip sent the plaintiff plunging several feet forward. To prevent falling, the plaintiff grabbed on to the handrails of the step leading to the door. The plaintiff's arm was twisted. The plaintiff's upper left arm was broken requiring plates and screws to be inserted into her arm.

Settlement Discussions

The plaintiff demanded $80,000. The case settled at mediation for $57,500 before Douglas A. Glass of Glass Mediations.
