Facts
The plaintiff alleged that when he was a minor he was repeatedly sexually abused by his physician, a pediatric endocrinologist. The plaintiff also alleged that the doctor sexually abused other boys. During the alleged molestations, the doctor was employed by Doe Medical Group. The plaintiff contended that Doe Medical Group knew of the doctor's sexual abuse of minors and that it had received notice from a mother of another patient that her son had been molested by the doctor. Doe Medical Group failed to take action other than to remove the locks from the doors of the examination rooms. Doe Medical Group disputed it had notice.
Settlement Discussions
The plaintiff made a C.C.P. Section 998 demand on defendant Doe Medical Group for $2.5 million. Defendant Doe Medical Group did not respond.
Result
The plaintiff settled with defendant Doe Medical Group for $1.25 million cash and $1 million in a structured settlement, for a total present day value settlement of $2.25 million.
