Contentions
PLAINTIFF'S CONTENTIONS:
Juarez alleged that he was employed by Radio Shack for nine years, first as a sales associate and then as a manager. Juarez also alleged that shortly after Radio Shack hired a "wireless expert" to increase sales at his store, Juarez reported this new employee to the district manager for poor customer service and unethical and possible illegal transactions, based, in part, on 25 customer complaints against the new employee. Juarez further alleged that, on July 27, 2010, during Radio Shack's investigation about his report on the "wireless expert," Juarez was questioned about a discount he had given a customer in January, as well other minor incidents he was involved in. Juarez alleged that shortly thereafter he was wrongfully terminated based on his disclosure of unethical and illegal practices taking place at his store.
Result
The jury found in favor of Juarez and awarded him $7,383,100 in damages. The jury found that Juarez's internal complaint of illegal, fraudulent, or unethical practices were a substantial motivating reason for Radio Shack's decision to terminate him. The jury also found that Radio Shack discharged Juarez without good cause.
