Patricia Patrick filed a complaint seeking judicial review of the Commissioner of Social Security's denial of her application for supplemental security income under the Social Security Act.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff was allegedly disabled due to various medical conditions, including fibromyalgia, degenerative arthritis of her back, osteoporosis, shoulder injuries, carpal tunnel syndrome on her left hand, anxiety and depression. In 2016, plaintiff sought SSI benefits, asserting the alleged onset of her disability in February 2012, and had been unable to work because of her medical issues. Among other things, plaintiff claimed her legs would "give way," causing her to suffer from falls and that she also suffered from depression. Despite her medical issues, the administrative law judge discredited plaintiff's claims and rejected her treating physician's opinion in ultimately denying her SSI benefits. Plaintiff argued the ALJ provided no reason for rejecting her credibility and that her medical records and other evidence supported her doctor's opinion. Plaintiff sought remand for benefits or, alternatively, remand for further proceedings.
Result
The court agreed with Patrick and granted her summary judgment motion. Accordingly, the court remanded the matter for further consideration.
