Facts

Plaintiff, a 15-year-old then, was acquainted with the defendant's daughter. While playing basketball in a neighborhood park, the defendant appeared at the park looking for his daughter. Angered because he could not find his daughter, the defendant damaged plaintiff's motor scooter and then picked up the plaintiff and shook him while asking plaintiff where his daughter was.
