Facts
Direct purchaser plaintiffs filed a class action against NEC Corp. and several others, in connection with the manufacture, supply, distribution, and sale or pricing of Optical Disk Drives.
Defendants also included Sony Corp., Sony NEC Optiarc Inc., Sony Electronics Inc., LG Electronics Inc., Hitachi, Ltd., Hitachi-LG Data Storage Inc., Toshiba Corp., Samsung Electronics Co. Ltd., Toshiba Samsung Storage Technology Corp. Korea, Koninklijke Philips Electronics N.V., Philips & Lite-On Digital Solutions Corp., BenQ Corp., TEAC Corp., Quanta Storage, Inc., and Panasonic Corp.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiff contended that defendants conspired to fix the prices of optical disk drives, beginning in January 2004 until at least January 2010. Plaintiff also contended that defendants facilitated the conspiracy by engaging in bid rigging, among others.
Result
Plaintiffs reached a settlement with NEC Corp. for $6 million.
Other Information
On Nov. 1, 2013 defendants Panasonic Corp. and Panasonic Corp. of North America settled with plaintiffs for $5,750,000. Plaintiffs have also settled with LG Electronics, Inc., LG Electronics USA, and Hitachi, Ltd. In November 2012 plaintiffs reached a $26 million settlement with Hitachi-LG Data Storage Inc., and Hitachi-LG Data Storage Korea.
