Facts

Faulkner Literary Rights LLC filed a copyright infringement suit against Sony Pictures Classics Inc. Faulkner's claims arose out of Woody Allen's movie, Midnight in Paris, and Sony's use of a quote from William Faulkner's book, Requiem for a Nun. The dispute centered on the Requiem quote, "The past is never dead. It's not even past." The movie contained the quote, "The past is not dead. Actually, it's not even past. You know who said that? Faulkner, and he was right. I met him too. I ran into him at a dinner party."

Sony sought to dismiss the complaint.

Result

U.S. District Court Chief Judge Michaeil P. Mills granted Sony's motion to dismiss.
