Plaintiff Ernest Deri, a retiree in his 60's, was seen by Defendant Richard E. Schweitzer, M.D., a dermatologist on May 21, 1992, with complaint involving a lesion in his mouth. Defendant diagnosed the lesion as thrush. Plaintiff was seen several times with an evolving diagnosis including lichen planus. Ultimately Plaintiff was sent to UCLA where he was diagnosed with squamous cell carcinoma of the cheek.
