Facts

On December 7, 1992, three officers from the Defendant County of San Bernardino Sheriff's Department went to the home of Jack and David Townsend. Without a warrant, the officers entered the residence, allegedly searching for a suspected felon; the suspect had no connection with the Townsend residence. During the entry, Jack Townsend became irate and demanded that the officers leave his home. The officers continued their search and found nunchakus and 2 marijuana pipes. During the incident, Jack Townsend suffered a heart attack and died. Plaintiffs were the decedent's 2 sons and daughter.

Plaintiffs contend they made a 998 demand of $250,000 and Defendants made a 998 offer of $10,000.
