On September 30, 1993, Defendant's bus attempted to pass Plaintiff Leonard Okun's automobile on the right side. The left rear bumper of the bus brushed the right rear bumper of Plaintiff's Mercedes. At the time, Plaintiff was a 52-year-old medical doctor. Defendant admitted liability during trial; the case proceeded to the jury on issues of causation and damages.
