Facts

On March 23, 1994, Defendant bus operator allegedly ran a red light and struck Plaintiffs' pick-up truck in a broadside collision. The collision allegedly caused Plaintiffs' pick up to careen out of control and strike another vehicle. At the time, these four Plaintiffs were farm laborers; three were approximately 20 years of age; and the fourth was approximately 32. The occupants of the second vehicle filed a separate lawsuit which was consolidated with the instant case; and at the time of settlement, the issues of the second vehicle were not resolved; a complaint was filed to preserve the statute of limitations.

Settlement Discussions

Defendant contends that two Plaintiffs settled out early; and that the (remaining) 20-year-old Plaintiff demanded $50,000 to $60,000 and the 32-year-old Plaintiff demanded $100,000.

Injuries

Plaintiff 32-year-old laborer: comminuted fractures of the right superior and inferior pubic rami requiring open reduction internal fixation with resultant non-union until July of 1994; right elbow injury, thoracic and lumbosacral sprains and strains, and right hip strain requiring physical therapy. The other three Plaintiffs sustained soft tissue injuries to neck, back, abdominal wall, shoulder, and hip requiring emergent care and chiropractic treatments. One Plaintiff was in the early stages of pregnancy at the time of the incident.
