Facts
Plaintiff Mario Griego, a 52-year-old cosmetologist, was hospitalized in May of 1992 for back surgery. On June 2, 1992, he presented to Defendant Mission Hospital Regional Medical Center with complaints of a swollen right knee which was warm to the touch and discolored. The laboratory findings were somewhat equivocal; and based on observation of crystals in the knee fluid, Defendant Dr. William Sheil, M.D., diagnosed pseudo-gout, rather than an infectious process. Plaintiff was sent home and returned 2 days later; at this time a culture and sensitivity study revealed the existence of 2 colonies of E-coli bacteria. Plaintiff was hospitalized.
