In July of 1992, Plaintiff Mrs. Josephina Israel, a 53-year-old bookkeeper, presented to Defendant Dr. Memmet Kasim, OB/GYN; this was her first visit with Defendant; the purpose was a routine examination. She had a 10-year history of urinary stress incontinence on sneezing, bowling, and jogging; she had been spotting for 5 days. Following a pelvic examination and vaginal ultrasound, Defendant Kasim recommended a total hysterectomy, after receiving a concurring second opinion. On September 1, 1992, Plaintiff underwent the surgery which included the following: vaginal hysterectomy; anterior and posterior repair; laparotomy; and bilateral salpingo-oophorectomy with lysis of adhesions. During surgery Mrs. Israel's bladder and rectum were injured, resulting in the formation of a vesicovaginal fistula and a rectovaginal fistula; this ultimately caused leakage of urine and feces as well as gas from the vagina, approximately one week post-operatively. In May of 1993, Plaintiff underwent a second surgery to repair the 2 fistulas.
