On December 5, 1993, at approximately 7:30 p.m. Plaintiff John Hannigan, a 69-year-old retiree had walked across Defendant Boston Shaft Restaurant's parking lot on foot when he tripped and fell over a vehicle berm. He fell on outstretched arms, resulting in injuries to his right arm, wrist, and elbow. The incident occurred while Defendant restaurant was closed.
