Plaintiff Timothy Groth, a 36-year-old sales representative, was injured in a medical malpractice incident on June 19, 1989. Following the incident, he was contacted by "Capper" of Defendant lawfirm; he retained Defendant firm. Defendant did not meet or talk to Plaintiff; treatment had been terminated by the underlying Defendant's medical group while Plaintiff was still symptomatic; and Defendant settled the case for $9,000 in February of 1990, despite Plaintiff's later undergoing surgery.
