Facts
On October 3, 1990, Plaintiff, a 28-year-old painter, suffered second and third-degree burns in an explosion caused by flammable paint fumes. He died three days later after a debridement procedure at Defendant hospital. His estate and heirs sued the hospital, treating physicians, and Hoffmann-La Roche Inc., which manufactured a sedative drug, Versed, that was administered to decedent following the debridement procedure. The hospital and physicians settled and/or were dismissed prior to trial.
Settlement Discussions
Per Defendant, Defendant offered $40,000; Plaintiff demanded approximately $600,000.
Injuries
Plaintiff suffered second and third degree burns over 38% of his body and died.
Other Information
In a special verdict, the jury found (11-1) that the drug did not cause or contribute to decedent's death. This case was filed on February 15, 1991; four years, 10 months and one week prior to this result.
