Facts

The plaintiff, a 57-year-old retired licensed vocational nurse from California, traveled to the defendant hotel in Las Vegas, Nevada for a retirement holiday. She heard a noise in the bathroom of her hotel room. She entered the bathroom and slipped on water which covered the floor when the sink pipe spontaneously separated. The plaintiff injured her lower back and buttocks. She hit her left ankle on the toilet. The P-trap had separated from the sink, causing the bathroom to flood. The defendant hotel had been open approximately one year and had P-trap problems in other guest rooms prior to the accident.

Settlement Discussions

Per the plaintiff, the demand was $500,000 and the defendants offered $175,000. Per the defendant, the plaintiff demanded $530,000 and the defendant offered $250,000. The case settled a week before scheduled trial.

Injuries

Herniated disc treated by a penniculectomy (removal of the abdominal flap) and a laminectomy. The plaintiff's preexisting lupus was allegedly reactivated by the surgeries and manifested in the form of open sores and peeling over 70% of her body. The plaintiff fully recovered from her injuries.

Other Information

Litigation is on-going as to the defendant hotel's cross-complaints. The case was settled approximately 2 years after it was filed.
