On January 29, 1993, plaintiff, a 34-year-old housewife and mother, was bowling at the defendant bowling alley. She sat down on a chair at the scoring table and it collapsed under her. The chair was manufactured by defendant manufacturer 25 to 30 years ago, after which defendant manufacturer sold its division to defendant successor-in-interest, who in turn assigned and sold its corporate division to other companies over the years. The chair was metallurgically defective in that the spot welds were inadequate and incomplete. The chair had been subjected to post-manufacturing arc welding by the defendant bowling alley or its predecessor.
Settlement Discussions
The settlement discussions were not disclosed. The case settled at a third settlement conference with the honorable Philip Schwab at JAMS within 10 days of the trial date.
