On January 15, 1993, the plaintiff, Marilyn Mansdorf, a 56-year-old retired legal secretary, was referred to the defendant, Irvine Medical Center, for a bone scan. While at the defendant, Irvine Medical Center, the plaintiff received an injection of a nuclear isotope into her left arm. She immediately complained of pain and burning. The plaintiff returned to the emergency room on January 18, 1993, with a nine by six centimeter inflamed area on her left arm. She was seen twice in the emergency room and referred to a general surgeon. The plaintiff did not treat again for twenty-two months. An MRI, ultrasound and nerve conduction tests all proved negative in December of 1994. The plaintiff did not treat again for twenty-two months. The plaintiff brought this action against the defendant, Irvine Medical Center, based on a medical negligence and violations of the Fair Debt Collection Practices Act theories of recovery.
Settlement Discussions
The plaintiff made no settlement demand. The defendant made a C.C.P. º998 offer of compromise for $5,000 and offered $10,000 during trial.
