In 1988, the plaintiff, a shopping center, leased premises to the defendant, a mexican restaurant. The lease was for 20 years, was to expire on August 31, 2008 and the rate on the lease was $13,000 a month. In April of 1993, after the defendant made various unseccessful efforts to amend the lease, the defendant abandoned the premises. The plaintiff brought this action against the defendant based on breach of contract theories of recovery.

Settlement Discussions

No meaningful settlement discussions were held before the mandatory settlement conference.

Damages

The plaintiff claimed $2,500,000 in damages for past and future rent.

Other Information

The settlement was reached approximately two years and nine months after the case was filed. A mandatory settlement conference was held on January 12, 1996 before Commissioner Wade D. Olson of the Los Angeles Superior Court, East District, resulting in the settlement.
