Facts
On July 23, 1995, the defendant, Henry Franklin, a 46-year-old teacher, became involved in a landlord-tenant dispute with a tenant to whom he leased his residential income property. The defendant was allegedly attempting to regain possession of his property when the dispute arose. The tenant requested assistance from law enforcement and a sheriffÆs deputy was sent to the property to conduct an investigation. The deputy telephoned the defendant from the rental property for information and the defendant allegedly responded with terrorist threats on the deputy in violation of Penal Code º422. The defendant allegedly stated: "IÆm on my way over and one of us is going to the morgue." The defendant then went to the rental property and an altercation ensued between the defendant and the investigating deputy. The defendant allegedly attempted to run down the officer with his vehicle and allegedly obstructed and delayed the officer. The defendant was charged with violation of Penal Code ºº148, 241(b) and 422.
