On April 2, 1993, the decedent, Allyson Baker-Grant, a 6-year-old girl, was horseback riding at the defendant riding stables and adjacent properties. The riding stables were owned by the defendant, Terry Foladare, who settled before trial. The adjacent properties were owned by defendant Southern Calif. IBEW-NELA pension plan, and managed by defendant American Realty Advisors. The decedent allegedly slipped from the saddle of her horse and was hanging from a strap that secured her to the saddle. The horse became frightened, bolted back toward the stable and attempted to jump the cable gate. The decedent was clotheslined by the neck on the cable gate, which resulted in her death. The decedent's brother and grandfather witnessed the accident. The plaintiffs, the decedent's parents, brother and grandfather, brought this action against the defendants, the stable, the landowner and the property manager, based on negligence, premises liability and inflicton of emotional distress (Dillion v. Legg)

Settlement Discussions

The plaintiffs made a C.C.P. º998 settlement demand for $300,000 which was reduced to $200,000 at trial.
