On March 21, 1994, the plaintiff, a 69-year-old retired man, was traversing the stairwell to his apartment when he slipped. He grabbed the hand railing which gave way. The plaintiff slammed into the side of the building and sustained injuries. The plaintiff brought this action against the defendants, the owner and property manager, based on negligence and premises liability theories of recovery.

The plaintiff made a settlement demand for $60,000. The defendants made no initial settlement offers.
