Facts
On October 9, 1995, the plaintiffs, a 5-year-old girl and her parents, were eating at the defendant fast food restaurant. One of the defendant's employees and a customer of the defendant restaurant started arguing with one another. The argument escalated into a fight wherein blows were exchanged. The defendant employee then removed his battery operated belt (which was secured at his waist) to strike the customer. As the defendant employee swung the belt, a battery from the belt flew across the room (approximately 20 feet) and struck the plaintiff in the forehead. The plaintiffs brought this action against the defendants based on negligence theory of recovery.
