On April 10, 1994, the plaintiff, a 6-year-old boy, was playing in his defendant neighbor's yard when the defendant's sharpei dog jumped up and mauled him without warning. The plaintiff sustained multiple bite wounds (mostly to his neck and face) requiring emergency suturing. The plaintiff brought this action against the defendant based on negligence and strict liability theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $100,000. The defendant made no initial settlement offers before agreeing to pay $100,000 (policy limits).
