Facts

On Jan. 20, 1995, the defendant driver, in the course and scope of his employment for the defendant company, negotiated a left-hand turn mid-block in front of the decedent, a 26-year-old electrical parts assembler, who was driving a Chevrolet Geo. The decedent sustained soft tissue injuries and right knee pain in the accident. Three months after the accident, the decedent's general practitioner referred him to Los Angeles County Hospital for a right knee consultation. On April 4, 1995, he died from deep vein thrombosis of the legs, pulmonary thromboembolism. The hospital was not a defendant nor a cross-defendant. The decedent was not wearing a seat belt at the time of the accident. The plaintiffs, the decedent's 4-year-old daughter and parents, brought this action against the defendants, the driver and his employer based on wrongful death, negligence and respondeat superior theories of recovery.

Settlement Discussions

The plaintiffs made a $1 million demand and the defendants made no settlement offers prior to the settlement conference.

Damages

The plaintiffs claimed wage loss. The plaintiff child was receiving $200 per month plus miscellaneous clothing and the parents were receiving approximately $400 per month. The defendants disputed that the decedent's parents were financially dependent.

Other Information

The settlement was reached approximately one year and ten months after the case was filed.
