On July 27, 1994, the plaintiff, a 39-year-old mechanic, was riding a Harley Davidson motorcycle traveling on Franklin Street in San Francisco, when he suddenly struck by the defendant driver, who was operating a rental vehicle owned by the defendant rental car company. The defendant driver was a native of Switzerland and was in San Francisco for a vacation. After the accident he returned to his native country. The plaintiff brought this action against the defendants, the driver and the rental car company, based on negligence theories of recovery.
