Facts
On Jan. 20, 1995, the decedent, a 36-year-old assistant manager of a clothing store, was either walking or running in a crosswalk at the intersection of Howard and Fremont in San Francisco. The defendant driver was driving a U-Haul truck for his employer, the defendant moving company and business service. The defendant driver made a left-hand turn and struck the decedent while she was in the crosswalk. The decedent died as a result of massive head injuries. The plaintiffs, the decedent's four minor children and 67-year-old father, brought this action against the defendants, the driver and his employer based on negligence theories of recovery.
Settlement Discussions
The plaintiffs made a settlement demand for $2 million. The defendants made a settlement offer of $900,000 at the mediation.

The settlement was reached approximately two weeks after the case was set for trial and five weeks before the continued trial date. A mediation was held on Sept. 6, 1995 before Judge Daniel H. Weinstein, retired, of JAMS/Endispute. It did not resolve the matter.
