Facts

On April 5, 1994, plaintiff Mark Cohen, a 38-year-old mortgage banker, was traveling in the number one lane of the 91 freeway when he allegedly took evasive action to avoid a collision when he crashed into the center divider. The plaintiff claims the incident was a result of defendant Alvarado Rodriguez' negligence. Rodriguez was traveling westbound on 91 freeway in number 3 lane when he allegedly striking a second vehicle operated by Carlos Calderon, who then veered across the freeway. The plaintiff crashed into the center divider when he attempted to avoid Calderon. The plaintiffs, husband and wife, brought this action against the defendants based on negligence and loss of consortium theories of recovery.
