On July 7, 1993, the plaintiff, a 29-year-old operations manager, was struck head-on by an underinsured motorist (UIM) when the driver crossed a double yellow line of a two-lane roadway. The plaintiff brought this action against the defendant UIM driver based on negligence. He brought an action against his own insurer, the defendant insurance company for UIM benefits.
