Facts
On Nov. 21, 1991, the plaintiff, a 48-year-old rock, sand and gravel operator, was driving a 1987 4-wheel drive vehicle made by the defendant auto manufacturer on the Bardsdale bridge on Highway 23 in Filmore. The defendant driver who was driving a 1983 truck on the bridge in the opposite direction, struck curb on right side of the narrow bridge and deflected into the oncoming traffic lane, striking the plaintiff's vehicle head-on. The plaintiff brought this action against the defendants, the auto manufacturer, the uninsured driver and the state, based on negligence and product liability theories of recovery. The defendant driver and defendant auto manufacturer settled before trial for a confidential amount.
