Facts

On June 9, 1994, plaintiff Gus Dailey, a 45-year-old legal assistant, was sitting in defendant Starbucks Coffee Shop when a glass lamp shade fell on or near him. The plaintiff got glass in his eye, which was washed out by the paramedics. The plaintiff claimed the lamps were negligently installed by defendant Starman Electric. The plaintiff brought this action against the defendants based on premises liability, negligence and product liability theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $300,000. Per the defendant Starbucks, the plaintiff made a settlement demand for $75,000 as to defendant Sturbacks; $30,000 as to defendant Starman Electric; and $70,000 as to defendant Architech Detail. The defendant Starbucks paid $10,000 in medical payment.
