Plaintiffs Bruce Heverly, a 38-year-old salesman from New Jersey, and Linda Cromer and Tyler Cassell, both sales agents over 45-year-old from New York, were former independent contractor sales agents of defendant, Transworld Systems, Inc., a nationwide collection agency. In September 1993, the plaintiffs and others filed two state court actions against the defendant. Plaintiff Cassell sued for breach of contract; plaintiff Cromer sued for wrongful termination and plaintiff Heverly sued for both wrongful termination and breach of contract theories of recovery.

The plaintiffs made a settlement demand in excess of $250,000. The defendant made no settlement offer.

Plaintiff Heverly claimed $252,000 in damages. Plaintiff Cromer claimed $60,000 in damages. Plaintiff Cassell claimed $52,000 in damages.
