Facts
On March 16, 1994, plaintiff Veana Pearson, a 52-year-old homemaker/ranch owner, was arrested for interfering with the defendant County of Marine police officers after the officers entered the plaintiff's property to recover a stolen vehicle. The defendants had received a tip from a citizen informant that drug and suspicious activity were occuring in a barn on the plaintiff's ranch. The defendants ran the license plates of a vehicle on the plaintiff's property and discovered a stolen vehicle. Pursuant to Vehicle Code º22655.5. without warrant, the defendants entered the plaintiff's property. The plaintiff brought this action against the defendants based on violation of civil rights theories of recovery.
Settlement Discussions
The plaintiff made a C.C.P. º998 settlement demand for $100,000 reduced to $35,000. The defendants made a C.C.P. º998 offer of compromise for $20,000.
Injuries
The plaintiff claimed exacerbation of bilateral carpal tunnel syndrome.
Other Information
A mediation was held on before Nelson Barry III of AAA resulting in no settlement.The plaintiff's motion for new trial was granted. The defendant's appeal on the Judge's order is pending.
