Facts

On June 7, 1996, plaintiff Robert Orlando, a 35-year-old maintenance worker at the Disney Consumer Products offices in Glendale was asked to install a new 2x2 light fixture in a work cubicle. After installing the new fixture, the plaintiff ran a conduit to an existing light, which he dismantled to get at the wiring. He then found a near by junction box which was marked and threw the correspanding breaker in the electrical room. Without any further safety checks, plaintiff stood on the top cap of his ladder and upon splicing the existing wires, received a 277 volt shock into the right hand, across the chest and out the left hand. The plaintiff brought this action against the defendant based on negligence.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $100,000. The defendant made a C.C.P. º998 offer of compromise for $2,500.

Damages

The plaintiff claimed $1.1 million in damages for his cognative impairment and loss of society as well as a projected second right shoulder decompression.

Injuries

The plaintiff suffered cognative impairment; loss of libido; sprain and strain neck and back; right shoulder impingment leading to a decompression and a Mumford procedure.

Other Information

The verdict was reached approximately one year and 10 months after the case was filed. The plaintiff purchased a $96,000 worker's compensation lien prior to trial. A crash settlement conference was held in Glendale in December 1998, which did not result in settlement. Defendants Disney and Athena Engineering settled out prior to trial. Defendant contractor DPR Construction was dismissed prior to trial with a summary judgment pending.
