Facts
On April 30, 2000, the plaintiffs, a grandmother, a mother and two young children, were stopped at a red light at
an intersection. The light turned green and the plaintiffs proceeded into the intersection, where they were
broad-sided by the defendant driver, who ran a red light. The driver was delivering furniture for his employer,
defendant C. Shops.
Settlement Discussions
No depositions were taken by any party. The plaintiffs served a C.C.P. Section 998 offer to compromise for the policy limits. The defendantÆs expert neurologist evaluated the neurologically injured child. The case then settled for the $500,000 policy limits.
Damages
The plaintiffs sought $75,000 in economic damages for their collective past medical bills and non-economic damages for their pain and suffering.
Injuries
The plaintiff grandmother suffered a fractured arm. The plaintiff mother sustained various soft-tissue injuries to her neck and back and a severely bruised abdomen. One plaintiff child suffered minor soft-tissue injuries. The other plaintiff child suffered a moderate closed-head injury, resulting in short-term neurological damage.
