Facts
On June 18, 1997, the plaintiff was shot by the defendant Nolte, an officer of the Los Angeles Police Dept.,
during the execution of a narcotics search warrant at the plaintiffÆs motel room. The defendant was alleged to
have used excessive force. Two other police officers, officer Kozak and officer Chavez, who were present at the
time, were alleged, along with the defendant, to have falsely arrested the plaintiff.
Settlement Discussions
The defense put forward an offer of $20,000 for the entire case (excessive force and false arrest) to include attorneyÆs fees and costs. The plaintiff had offered to settle for $400,000.
Injuries
The plaintiff lost the index finger on the right hand and the tip of the right ring finger. He also suffered major damage to the middle finger, the thumb of the right hand and minor damage to the left thumb. As a result, the plaintiff lost the use of his dominant hand.

Hung jury on the issue of false arrest requiring a retrial on this count.
