Facts

The plaintiff was employed by the defendant and his specific duties were to check drafts of aeronautical charts for errors and correct them. He found errors and advised management. He later volunteered to his employer that he had removed hundreds of pages of company documents and had taken them to the National Transportation Safety Board (NTSB) and that he intended to continue such unspecified "outside" activities. The defendant employer asked him to agree that he would cease and desist from removing company documents without consent. He refused to agree and the defendant employer suspended him with pay for three days and asked him to reconsider. He took the paid leave but refused to agree to the employer's request and was subsequently fired.

Settlement Discussions

The plaintiff offered to settle for $965,000, subject to that being accepted by June 15, 2000. The offer was then to increase by $50,000 on the first and fifteenth of each month thereafter.

Injuries

The plaintiff claimed back pay losses of $72,355, loss of future earnings of $1,000,000 and damages for emotional distress in the amount of $1 million.

Result

The jury found for the defendant on the claims of wrongful discharge, breach of contract and breach of good faith and fair dealing, and awarded backpay of $72,355 to the plaintiff.
