On April 28, 1999, the defendant rear-ended the plaintiffs' stopped vehicle at about 55 mph causing it to strike
the vehicle in front. The plaintiffÆs auto was totaled. The plaintiff Gonzales, the rear seat passenger, alleged
lower right extremity nerve damage and soft tissue injury to the neck and back.
The defendant did not dispute liability and contended that although the impact was substantial, the plaintiff's
injuries were minor.
