Facts

Plaintiffs A Country Club and AÆs director and officersÆ insurer, B Insurance Co. filed this attorney malpractice
action against defendant law firm and its members.
The plaintiffÆs lawsuit alleged that the defendant law firm committed malpractice in connection with AÆs
attempt to renew its lease with the C Water District. Plaintiff A alleged that the attorneys failed to properly
advise it in connection with that lease. Plaintiff A further maintained that as a result of the dispute as to its
renewal of its lease, it was forced to purchase the property at a cost of over $15 million and to defend and settle
lawsuits by its members.
Defendant law firm disputed the allegations of the complaint and denied that they were
negligent or that their conduct caused any damage to the plaintiffs.

Settlement Discussions

The plaintiffs made claims to defendant law firm. In July 2000, the parties participated in a mediation that took place before retired Supreme Court Justice Edward Panelli but did not reach a settlement.
