The University of Colorado Environmental Health and Safety department employed Michael Law and Richard Siani. James Fedenrecht was the Director of Safety for the university and Nancy Felock was the Hazardous Materials Manager. The court granted judgment as a matter of law regarding Siani's claim for damages resulting from a heart attack he claimed resulted from the work environment, and the exemplary damage claims against James Fadenrecht and Nancy Felock. The defendants Dave Wergin and Michael Morrison who were sued in their official capacity, were dismissed.
