Facts

On Jan. 18, 2000, at 7:30 p.m., the plaintiff, a four-year resident of defendantÆs apartment
complex, was walking from the first floor to the second floor in a common area of her apartment
building. After walking up the staircase that led into a hallway, the overhanging light was
allegedly not functioning, rendering it dark and extremely difficult to see where she was walking.
The plaintiff tripped and fell on a raised metal threshold, which was allegedly raised
approximately two inches from floor. As a result of the accident, the plaintiff fractured her right
ankle.

Settlement Discussions

The plaintiff demanded $35,000, but the defendant offered nothing. On Sep. 25, 2001, a one and one-half hour court ordered mediation was held in front of William Remery. This mediation resulted in the $18,000 settlement.
