Facts
In July 1999, the plaintiff, a 39-year-old male, while at work sustained a back injury. On Sep. 27,
1999, the defendant performed a bilateral microdiskectomy at L5-S1. The procedure appeared to
have been without incident. However, after approximately five days, the plaintiff began to
experience swelling of the left lower extremity. Initially, a Doppler study was normal. However,
subsequently, on October 7, a Doppler study suggested an arterial venous fistula. The plaintiff
was taken back into surgery where he lost an estimated 7500 ccÆs of blood.

The plaintiff made a demand of $250,000. The made no offer.
Injuries
The plaintiff complained of low back pain, left leg pain, foot numbness, varicose veins, difficulty with urination and ejaculatory and erectile dysfunction.
