Facts

The plaintiff, a 57-year-old male automotive service repair advisor, had a heart attack while camping in the desert in November 2001. He had seen Dr. Kwok in the spring of 2001. At that time, he had a normal EKG, elevated cholesterol (untreated), and a history of smoking. The defendant recommended that the plaintiff should diet and exercise to attempt to control his cholesterol, and planned for the plaintiff to return in six months. The plaintiff returned to work following his heart attack.
