The plaintiff, a 57-year-old male automotive service repair advisor, had a heart attack while camping in the desert in November 2001. He had seen Dr. Kwok in the spring of 2001. At that time, he had a normal EKG, elevated cholesterol (untreated), and a history of smoking.
