The plaintiffs are homeowners who had bought new homes in Riverbank constructed by the defendant. The plaintiffs claimed that they began to notice that their backyards did not drain well, and that they suffered exterior cracking of stucco, interior cracking, roof leaks and water migration from their slabs. The plaintiffs sued the defendant and alleged causes of action for construction defect, negligence and strict liability.
