Facts

Plaintiff Steve Munt ate a meal at defendant Sizzler restaurant in Mountain View. The meal consisted of two steaks with bacon and mushrooms. The plaintiff finished the first steak but ordered the second re-cooked because it did not look properly done. He took one bite of the second steak and left the restaurant. Twelve hours later, the plaintiff had severe abdominal pain and diarrhea. A few days later, he was admitted to the hospital for five days. Medical tests were negative for food-borne bacteria.
